Sponsor-a-Plank Donation Scheme

Terms and Conditions

The sponsor’s attention is specifically drawn to the provisions of clauses 11, 12, 13, 14, 15, 16 and 21 which limit the liability of The Swanage Pier Trust to the sponsor.


As part of the Sponsor-a-Plank Donation Scheme, The Swanage Pier Trust (referred to as the Trust) provides single plaques which shall be fixed to Swanage Pier, with an inscription of the sponsors choosing up to a maximum of 30 characters, to commemorate individual donations made towards the support of plank/decking timbers.

  1. The sponsorship donation is £100.00.
  2. The sponsorship donation can only be paid by the sponsor using a debit card or credit card at the point of submission of the order.
  3. Orders will be handled on a first-come, first-served basis.
  4. The Trust, or those acting on its behalf, reserves the right in it’s absolute discretion to approve all lettering and to refuse any order. In such cases, the Trust has no obligation to cite reason for the refusal but will provide the sponsor with a refund of the price paid for that particular order.
  5. After submitting an order, the sponsor shall receive an email from the Trust confirming that the order has been received and attaching an electronic certificate.
  6. Any amendments to the inscription provided on the order form must be notified to the Trust by email to office@swanagepiertrust.com within seven days of the receipt of the confirmation email attaching the electronic certificate. Amendments notified within this deadline will be free of charge. No amendment to the inscription can be made after this deadline.
  7. Due to the fact that the plaques are of a personalised nature, the sponsor has no right of cancellation in respect of the order. No refunds will be given by the Trust once the order has been placed, save in respect of clause 4 above.
  8. Plaques normally take between 6 to 8 weeks to be laid following an order but can take longer depending on demand, for example during the Summer months this can be extended to 10-12 weeks.
  9. The Trust will have complete discretion over the location and installation date of the plaques.
  10. All plaques remain the sole property of the Trust.
  11. The Trust shall not be responsible or liable for the cleaning or maintenance of the plaques once they have been laid unless the sponsor has subscribed to the plaque cleaning service and the applicable fee has been paid by the sponsor or a third party.
  12. It is envisaged that the plaques will be displayed on Swanage Pier for a period of 25 years after which the commemorative plaque will be permanently removed. The Trust reserves the right to move or relocate the plaques without liability.
  13. Although of excellent quality and designed to last, the sponsor acknowledges, by placing the order, that plaques may become worn or damaged over time owing to natural causes. No liability can be accepted for this by the Trust.
  14. In addition, the sponsor acknowledges that Swanage Pier is open to the general public and the Trust accepts no liability for damage, loss, vandalism or theft of any plaque.
  15. Nothing in these terms shall limit or exclude the Trust’s liability for:
    1. death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors (as applicable);
    2. fraud or fraudulent misrepresentation; or
    3. 
breach of any terms implied by statute.
  16. Subject to clause 15:
    1. the Trust shall not be liable to the sponsor whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with these terms; and
    2. the Trust’s total liability to the sponsor for all other losses arising under or in connection with these terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total sums paid by the sponsor for the relevant order.
  17. By accepting these terms, the sponsor confirms that they have read and accept the Trust’s Privacy Policy.  The sponsor consents to the Trust providing the personal information collected about them to the supplier of the inscribed plaques and any other party who the Trust considers it necessary to receive such information in conjunction with the administration of the Sponsor-a-Plank scheme and plaque cleaning service.
  18. For health and safety and general maintenance reasons, we respectfully request that no floral tributes are to be left on the Pier at any time.
  19. Due to special events, essential repairs and renovations it may not always be possible to view the plaque, therefore it is advisable to check access before a visit.
  20. Plank sponsorship does not include free access to the Pier. This is charged at the standard strolling rate.
  21. The Trust will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these terms or for any damage or loss to any plaque that is caused by an event outside its control.  An event outside its control means any act or event beyond the Trust’s reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.
  22. Each of the paragraphs in these terms operates separately.  If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
  23. These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
  24. By placing an order, the sponsor and the Trust irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or their subject matter or formation (including non-contractual disputes or claims).

The sponsor also has the option at the ordering stage to subscribe for the plaque cleaning service provided by the Trust.  In addition to the above terms and conditions, the following terms shall apply to the plaque cleaning service:

  1. The sponsor or a third party can choose to subscribe to the plaque cleaning service for a single annual charge, which is currently £12 per year.
  2. The Trust will notify the sponsor or third party using the contact details held by the Trust when their subscription to the plaque cleaning service is due to expire and offer the sponsor or third party the opportunity to renew their subscription for a further 12 month period and specifying the applicable charge (currently £12 per year).
  3. Where the sponsor or third party has chosen to subscribe to the plaque cleaning service, the Trust shall only clean each plaque subscribed to the plaque cleaning service on one occasion in any given month.
